Welcome to TutoPost. By accessing or using the TutoPost application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years of age to use TutoPost. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's consent to use the Service. We reserve the right to terminate accounts of users who do not meet these requirements.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. TutoPost is not liable for any loss or damage arising from your failure to protect your account information.

4. Acceptable Use

TutoPost is designed for good-natured, constructive, and lawful use cases — such as sharing tutorials, recipes, how-to guides, event instructions, and similar instructional content. You agree to use the Service only for lawful purposes and in accordance with these Terms.

5. Prohibited Content

You may not create, upload, share, or distribute content that:

• Is illegal or promotes illegal activity in any jurisdiction
• Contains pornography, sexually explicit material, or sexual content of any kind
• Promotes, depicts, or facilitates violence, weapons, firearms, explosives, or instructions for creating them
• Promotes, depicts, or facilitates the use, sale, or manufacture of illegal drugs or controlled substances
• Contains or promotes abuse, harassment, bullying, threats, or intimidation of any individual or group
• Involves planning or coordination of illegal activities, including but not limited to fraud, theft, hacking, or trespassing
• Expresses intent to harm oneself or others
• Contains hate speech or content that discriminates against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or nationality
• Infringes on the intellectual property rights of any third party, including copyrights, trademarks, or trade secrets
• Contains malware, spam, phishing attempts, or other malicious content
• Impersonates another person, entity, or organization
• Is otherwise objectionable, harmful, or inappropriate as determined by TutoPost at its sole discretion

6. Reporting & Moderation

TutoPost relies on community reporting to maintain a safe platform. Any user may report content they believe violates these Terms. All reports are reviewed by our moderation team.

• Content found to violate these Terms may be removed without notice.
• Users who repeatedly post prohibited content or receive multiple reports may have their accounts suspended or permanently banned.
• TutoPost reserves the right to take action against any account at its sole discretion, including but not limited to issuing warnings, restricting features, suspending, or permanently terminating accounts.

7. Bans & Refund Policy

No refunds will be issued for accounts that are banned or suspended due to violations of these Terms, reported content, or abuse of the platform. This applies to all paid subscriptions, in-app purchases, and any other payments made in connection with the Service. By purchasing a subscription or making a payment, you acknowledge and accept this policy.

8. User Content

You retain ownership of any content you create and post through the Service. By posting content, you grant TutoPost a non-exclusive, worldwide, royalty-free license to host, store, and display your content solely for the purpose of operating and providing the Service. You may delete your content at any time, and it will be removed from the platform.

9. Expiration & Deletion

TutoPost allows you to set expiration dates on your posts. When a post expires, it will automatically become unavailable. You may also manually delete any post at any time. Deleted and expired posts may be retained in our backup systems for a limited period for technical purposes before being permanently removed.

10. Privacy

Your privacy is important to us. Please review our Privacy Policy for details on how we collect, use, and protect your personal information.

11. Intellectual Property

The TutoPost name, logo, design, and all related software, features, and content are the property of Gamiant and are protected by applicable intellectual property laws. You may not use, reproduce, or distribute any TutoPost branding or materials without prior written consent.

12. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. TutoPost does not warrant that the Service will be uninterrupted, secure, or error-free.

13. Limitation of Liability

To the fullest extent permitted by applicable law, TutoPost and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, profits, or business opportunities, arising out of or in connection with your use of the Service.

14. Indemnification

You agree to indemnify, defend, and hold harmless TutoPost, Gamiant, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with your use of the Service, your content, or your violation of these Terms.

15. Termination

TutoPost may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall survive.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
